Sahih al-Bukhari, Part Seven
, 3681. Furwah ibn Abi al-Mughra’ narrated to me, Ali ibn Musahhar narrated to us, on the authority of Hisham, on the authority of his father, on the authority of Aisha, may Allah be pleased with her, who said: The Prophet, may Allah bless him and grant him peace, married me when I was six years old. We went to Madinah and stayed with Banu al-Harith ibn Khazraj. I fell ill and my hair fell out and became very limp. My mother, Umm Ruman, came to me while I was on a swing with some of my friends. She cried out at me, so I went to her, not knowing what she wanted with me. She took my hand until she stopped me at the door of the house, and I was panting until some of my breath calmed down. Then she took some water and wiped my face and head with it. Then she brought me into the house, and there were some women from the Ansar in the house. They said: “On goodness and blessings and on good birds.” So I handed me over to them, and they put my affairs in order. I was not startled until the Messenger of Allah, may Allah bless him and grant him peace, came in the morning, so she handed me over. To him, and I was nine years old at that time
. To respond to this doubt, we say:
Marriage at such an age at that time was known and customary to everyone. In fact, it is known today that women in hot regions reach puberty at a young age. However, you will find a group of enemies of religion from among the Christians denying this and criticizing the Prophet, may God bless him and grant him peace, saying that he married a child!!!
This is a lie, and we will respond, God willing, from four aspects:
First: This type of marriage existed in the pre-Islamic era and was widespread and not reprehensible.
Second: This type of marriage exists and is legislated in the Jewish heritage and customs.
Third: Christian sources mention the young age of Mary when she married Joseph the carpenter.
Fourth: This type of marriage existed in Christian countries without denial
. Fifth: Scientific facts indicate that females reach puberty at an early age in hot regions .
First: The prevalence of this type of marriage in the pre-Islamic era among the Arabs, and no one denounced it.
There are many indications of the acceptance of marriage of young girls and boys, including:
1. That the Mother of the Believers Aisha, may God be pleased with her, was engaged to Jubair ibn Mut’im, may God be pleased with him, before her marriage to the Prophet , may God bless him and grant him peace.
We read in the Biographies of the Nobles by Imam Al-Dhahabi, may God have mercy on him, Part One:
((And Abdullah ibn Idris said, on the authority of Muhammad ibn Amr, on the authority of Yahya ibn Abd al-Rahman ibn Hattab, who said: Aisha, may God be pleased with her, said: When Khadija died, Khawlah bint Hakim came to the Messenger of God, may God bless him and grant him peace, and said: Why don’t you marry? He said: “And who?” She said: If you want a virgin, and if you want a widow. He said: “Who is the virgin and who is the widow?” She said: As for the virgin, then Aisha is the daughter of the most beloved of God’s creation to you . As for the widow, then she is Sawda bint Zam’a, who believed in you and followed you. He said: “Mention them to me.” She said: So I went to Umm Ruman and said: O Umm Ruman, what good has God brought upon you? Blessings! She said: What? She said: The Messenger of Allah (peace and blessings of Allah be upon him) mentioned Aisha. She said: Wait, for Abu Bakr is coming. So Abu Bakr came and I mentioned that to him. He said: Is she suitable for him, and she is his brother’s daughter? She said: Abu Bakr got up, and Umm Ruman said to me: Al-Mut’im ibn Adi mentioned her in reference to his son, and by Allah he never broke a promise, meaning Abu Bakr.She said: Abu Bakr came to Al-Mut'am and said: What do you say about this girl? She said: He turned to his wife and said to her: What do you say? She turned to Abu Bakr and said: Perhaps if we marry this young man to you, you will convert him and bring him into your religion. Abu Bakr turned to him and said: What do you say? He said: She says what you hear. Abu Bakr got up and had no intention of making a promise, so he said to her: Tell the Messenger of Allah, may Allah bless him and grant him peace, to come. So the Messenger of Allah, may Allah bless him and grant him peace, came and took possession of her. She said: Then I went to Sawdah bint Zam'a, and her father was an old man who had stopped performing the Hajj pilgrimage. I greeted him with the greeting of the people of the Jahiliyyah and said: Good morning. He said: Who are you? I said: Khawlah bint Hakim. He welcomed me and said what Allah willed him to say. I said: Muhammad bin Abdullah bin Abdul Muttalib mentioning Sawdah bint Zam'a. He said: A suitable and generous man. What does your companion say? I said: You like that. He said: Tell him to come. She said: The Messenger of Allah, may Allah bless him and grant him peace, came and took possession of her. She said: Abd ibn Zam’ah came and began to throw dirt on his head. After he had become Muslim, he said: I am foolish when I throw dirt on my head because the Messenger of Allah, may Allah bless him and grant him peace, married Sawdah. Its chain of transmission is good .
Sheikh Shu’ayb al-Arna’ut also classified its chain of transmission as good in his Takhreej of Siyar A’lam al-Nubala’, Part One, and he said: “ Its chain of transmission is good .”
There is a benefit in the hadith:
Khawlah bint Hakim is the one who went and proposed marriage to the Prophet, may Allah bless him and grant him peace, to Aisha, may Allah be pleased with her, and she did not see any difficulty in her young age, which indicates that this marriage was known among the Arabs before Islam as well .
2. The difference between Abdullah bin Amr and his father is eleven years, as narrated (and I will come to this point again).
We read from the Biographies of the Nobles by Imam Al-Dhahabi,
may God have mercy on him, Part Three: ((Abdullah bin Amr bin Al-Aas (peace be upon him), son of Wael bin Hashim bin Saeed bin Saad bin Sahm bin Amr bin Hisais bin Kaab bin Luay bin Ghalib.
The imam, the learned worshipper, the companion of the Messenger of God - may God bless him and grant him peace - and the son of his companion, Abu Muhammad, and it was said: Abu Abdul Rahman. And it was said: Abu Nasir Al-Qurashi Al-Sahmi.
And his mother is Ra’itah bint Al-Hajjaj bint Munabbih Al-Sahmiyyah, and his father is only eleven years older than him or so .))
3. What was narrated from Al-Hasan bin Saleh that he had a neighbor who was 21 years old and she was also a grandmother!!
Imam Al-Bukhari, may God have mercy on him, mentioned it in the fifth part:
((Chapter on the puberty of boys and their testimony and the saying of God Almighty: “And when the children among you reach puberty, let them ask permission.” Mughirah said: I had a wet dream when I was twelve years old. And the puberty of women during menstruation is due to the saying of God Almighty: “And those of your women who have despaired of menstruation” until His saying: “that they should give birth.” And Al-Hasan bin Salih said: I met a neighbor of ours, a grandmother of twenty-one years old. ”))
4. What was narrated that the Prophet, may God bless him and grant him peace, married his daughters at a young age.
We will give two examples of that:
1. Zainab, the daughter of the Prophet, may God bless him and
grant him peace . We read in the Great Classes of Ibn Saad the biography of Zainab, the daughter of the Prophet, may God bless him and grant him peace
: ((She is his eldest daughter. She was born when the Messenger of God, may God bless him and grant him peace, was thirty years old and she died in the eighth year during the life of the Messenger of God, may God bless him and grant him peace. Her mother was Khadija bint Khuwaylid bin Aslam.)) That is, when the Prophet, may God bless him and grant him peace, was sent, she was ten years old. It is known that she married Abu Al-Aas before the mission.
And the evidence from the beginning of the end by Ibn Kathir, may God have mercy on him, Part Five:
((Ibn Ishaq said: Abu al-Aas was one of the men of Mecca who were counted in wealth, honesty, and trade, and his mother was Hala bint Khuwaylid, the sister of Khadija bint Khuwaylid, and it was Khadija who asked the Messenger of God, may God bless him and grant him peace, to marry him to her daughter Zainab, and he did not disobey her, and that was before the revelation )
meaning Zainab married Abu al-Aas bin al-Rabi’ when she was less than ten years old.
2. The marriage of Ruqayyah, the daughter of the Prophet, may God bless him and grant him peace, to Utbah bin Abi Lahab when she was young.
We read in the book Al-Isti’ab fi Ma’rifat al-Ashab by Ibn Abd al-Barr:
((Abu Omar said: I do not know of any disagreement that Zainab was the eldest of his daughters, may God bless him and grant him peace. And there was disagreement about who came after her from them; Abu al-Abbas Muhammad bin Ishaq al-Sarraj mentioned, he said: I heard Abdullah bin Muhammad bin Sulayman bin Ja’far bin Sulayman al-Hashemi, he said : Zainab, the daughter of the Messenger of God, may God bless him and grant him peace, was born when the Messenger of God, may God bless him and grant him peace, was Thirty years old, and Ruqayyah, the daughter of the Messenger of Allah, may Allah bless him and grant him peace, was born, and the Messenger of Allah, may Allah bless him and grant him peace, was thirty-three years old.
Mus`ab and other genealogists said: Ruqayyah was married to Utbah ibn Abi Lahab, and her sister Umm Kulthum was married to Utaybah ibn Abi Lahab. When the verse {May the hands of Abu Lahab perish} was revealed, their father Abu Lahab and their mother Hamalat al-Hatab said to them: Leave the two daughters of Muhammad . Abu Lahab said: My head is forbidden to you if you do not leave the two daughters of Muhammad. So they left them.))
Meaning that Ruqayyah was seven years old when the Prophet, may Allah bless him and grant him peace, was sent
, and it is known that she married Utbah ibn Abi Lahab, may Allah be pleased with him, before the mission.
And we read in Al-Isabah fi Tamyiz Al-Sahabah by Ibn Hajar Al-Asqalani:
((Abu Omar said: I do not know of any disagreement that Zainab was the eldest daughter of the Prophet, may God bless him and grant him peace. There was disagreement about Ruqayyah, Fatimah, and Umm Kulthum, and most of them are in this order. Abu Omar narrated from Al-Jurjani that it was authentic that Ruqayyah was the youngest of them, and it was said: Fatimah was the youngest of them, and Ruqayyah was first with Utbah ibn Abi Lahab, and when the Prophet, may God bless him and grant him peace, was sent, Abu Lahab ordered his son to divorce her, so Uthman married her .))
So Ruqayyah, may God be pleased with her, married Utbah ibn Abi Lahab when she was before the age of seven and she was divorced after the revelation of Surat Al-Masad in the third or fourth year of the mission, then she married Uthman, may God be pleased with him, so
her age at the time of the divorce and the marriage to Uthman, may God be pleased with him, was approximately 10 or 11 years.
Second: The existence of child marriage in Jewish heritage and customs :
There is almost a consensus in Jewish sources on the marriage of children, but they differed among themselves on the minimum age for marriage:
1. Some of them said that the age of puberty and marriage in Judaism is 12 years :
We read from the Jewish Encyclopedia:
Some urge that children should marry as soon as they reach the age of puberty, i.e., the fourteenth year (Sanh. 76b); and R. Ḥisda attributed his mental superiority to the)) fact that he was married when he was but sixteen years old (Ḳid. l.c.). It was, however, strictly forbidden for parents to give their children in marriage before they had reached the age of puberty (Sanh. 76b). A man who, without any reason, refused to marry after he had passed his twentieth year was frequently compelled to do so by the court. To be occupied with the study of the Torah was regarded as a plausible reason for delaying marriage; but only in very rare instances was a man permitted to remain in celibacy all his life (Yeb. 63b; Maimonides, "Yad," Ishut, xv. 2, 3; Shulḥan 'Aruk, Eben ha-'Ezer, 1, 1-4; see Celibacy).....Minors (i.e., such as have not reached the age of puberty, which was held to begin at thirteen years in males, and twelve in females), are also precluded from contracting marriages (see Majority). A daughter who was a minor could be given in marriage by her father; and such a marriage was valid. In the case of her father's death, her mother or her brothers could give her in marriage, subject to her confirmation or annulment on her reaching the age of puberty(see Mi'un). A marriage contracted under certain conditions was valid when the conditions were fulfilled. The conditions had to be formulated in accordance with the general laws governing conditions (see Conditions).))

2. و منهم من صرح ان حد البلوغ و الزواج للمراة هو ثلاث سنوات و اجازوا ان يدخل بها زوجها بعد سن الثالثة و استشدوا على ذلك بان رفقة كان عمرها ثلاث سنوات حينما تزوجت من اسحاق عليه الصلاة و السلام !! .

And in a case where the childless husband of a girl who is three years and one day old dies, if his brother, the yavam, engages in intercourse with her, he acquires her as his wife; and if she is married, a man other than her husband is liable for engaging in intercourse with her due to the prohibition of intercourse with a married woman.))

The Gemara raises an objection to one element of the ruling of Rav from a baraita: One who loves his wife as he loves himself, and who esteems her by giving her clothing and jewelry more than he esteems himself, and one who instructs his sons and daughters to follow an upright path, and who marries them to appropriate spouses adjacent to their reaching puberty, ensures that his home will be devoid of quarrel and sin. Concerning him the verse states: “And you shall know that your tent is in peace; and you shall visit your habitation and shall miss nothing” (Job 5:24). The baraita indicates that it is a mitzva to marry one’s children to appropriate spouses while they are young, contrary to the statement of Rav that one who takes a wife for his minor son causes sin. The Gemara replies: Adjacent to their reaching puberty is different from marrying her to a minor, as there is no concern that his daughter will sin during the brief period until her husband reaches puberty. The Sages taught: One who loves his neighbors, and one who brings his relatives close, and one who marries the daughter of his sister, an example of a woman that he knows and likes before taking her as his wife, and one who lends a sela to a poor man at his time of need, when he has no alternative source of funds, with regard to each of them the verse states: “Break your bread for the hungry, and the poor that are cast out bring to your house; when you see the naked, you shall clothe him, and hide not yourself from your own flesh…then shall you call, and the Lord will answer; you shall cry, and He will say: Here I am” (Isaiah 58:7–9).

Moses ordered the leaders of his army to kill all the male children who, when they grew up, would become men who would resist the people and might be affected by what happened to their fathers, as well as all the non-virgin women, some of whom had been polluted by the previous seduction of the children of Israel, in addition to the fact that they… They bore the feeling of revenge for their husbands, but the children, the girls and the virgin girls, Moses kept them as captives and gifts for his men .

We read from the first volume of the Scriptural Dictionary, page 4:
((His life and reign: There is a problem with the dates mentioned in (2 Chronicles 28:1, 2 Kings 16:2) where we understand that Ahaz died at the age of thirty-six, while we read in 2 Chronicles (29:1) that his son Hezekiah took the throne at the age of twenty-five after the death of his father Ahaz, which means that Ahaz was eleven years old when Hezekiah was born . (And in the Septuagint version of 2 Kings 16:2 it is stated that Ahaz reigned at the age of twenty years, while we find in 2 Chronicles 28:1 that he was twenty-five years old, and there is much evidence supporting the older age mentioned in the Septuagint version of the Book of Chronicles) but the young age - in any case - is not impossible since we find in the East children at an early age, less than ten - marrying, and most of the kings of this era were born while their fathers were in the middle or late second decade ))

And also Antonius Fikry says in his interpretation of the Second Book of Kings, Chapter 16:
((Ahaz = his name was Jehoahaz and the writer of the book deprived him of the name Jehovah because he did not deserve it. We note in verse 2 that Ahaz was 20 years old when he became king and he reigned for 16 years, so he was 36 years old when he died. His son Hezekiah was 25 years old when he became king. It is not unlikely that Ahaz had Hezekiah when he was 11 years old, but by placing the verses in the following chapters and comparing them, it appears that Ahaz had Hezekiah at an older age than that (about 14 years old).))
Our evidence for this statement is divided into two parts:
1. Gospels and apocryphal writings state that Mary, peace be upon her, was 12 years old when she married Joseph the carpenter. The purpose of this evidence is to show that some Christian sects believed that Mary, peace be upon her, was 12 years old when she married .
We read from the Apocryphal History of Joseph the Naggar:
((3. Now when righteous Joseph became a widower, my mother Mary, blessed, holy, and pure, was already twelve years old . For her 389
parents her in the temple when she was three years of age, and she remained in the temple offered the Lord nine years. 4. Therefore they immediately sent out, and assembled twelve old men of the tribe of Judah. And they wrote down the names of the twelve tribes of Israel. Righteous Joseph therefore received my mother, and led her away to his own house. We read from the Apocryphal Gospel of James:

This is a clear indication that it is permissible for a Christian to marry and be engaged to a Christian woman who is under 12 years old, and to consummate the marriage if she is over 12 years old.

because each society is judged according to its own customs and traditions.

The foreign writer says that the age of marriage was young, and as soon as puberty came, males married at 14 or 15 years old, and females at 12 years old.
He continues that we should not be surprised by these marriages because the weather works to speed up puberty.
